# Trademark Protection: Key Lessons from TradeSun's Lawsuit Against OpenAI

Latino tech founders, here is the copycat nobody warns you about: the one with a bigger marketing budget than your whole company. On October 5, a California software company sued OpenAI over the name ASTRA. What it brought to court is the asset most growing startups put off: a federal trademark registration it filed in 2021, years before it needed one.

| 2021 The year TradeSun filed ASTRA for AI software. OpenAI released GPT-6 Astra on Sept. 3, 2026. |
| --- |

TradeSun Inc. filed its ASTRA application on May 28, 2021, claiming first use a week earlier, and received U.S. Registration No. 6,746,198 on May 31, 2022, for software as a service using artificial intelligence for document classification, data extraction and data processing, [according to the USPTO record](https://tsdr.uspto.gov/statusview/sn90742200). It markets ASTRA to banks and financial institutions for document automation and transaction verification, [per Lawyer Monthly](https://www.lawyer-monthly.com/2026/10/openai-faces-trademark-lawsuit-over-gpt-6-astra-name/).

On September 3, OpenAI released GPT-6 Astra, and it has since extended the name to products like Astra for Law, [per Law Commentary's report on the complaint](https://www.lawcommentary.com/articles/openai-astra-trademark-lawsuit-tradesun). TradeSun filed suit on October 5 in the Northern District of California, No. 3:26-cv-11360. It asks for an injunction, a ruling of infringement and an award of profits. OpenAI says the complaint lacks merit. These are allegations, and no court has ruled on any of them.

My position: TradeSun's strongest move happened in 2021, not this week. A registration is what turns "they took our name" into a case a federal court takes seriously against the most famous AI company in the world. Founders who plan to deal with the trademark after the raise, or after a problem shows up, are waiting for the exact moment it does the least for them.

## What is reverse confusion, and why should a growing startup care?

| **Reverse confusion is when a bigger company adopts a smaller company's name and floods the market, so customers start believing the smaller, earlier company is the copycat or is connected to the giant.** The Ninth Circuit, which covers California, recognized the theory in [DreamWerks Production Group v. SKG Studio (1998)](https://caselaw.findlaw.com/us-9th-circuit/1455238.html), a fight between a convention organizer and DreamWorks. It is the main legal tool a startup has when the copycat is bigger than it is. |
| --- |

The court in DreamWerks described the harm plainly: customers doing business with the smaller senior user might think they are dealing with the bigger junior user. That is the theory TradeSun is describing. Its complaint argues OpenAI's market presence could lead customers to associate Astra primarily with OpenAI, or to assume TradeSun is built on OpenAI technology, [per the same report](https://www.lawcommentary.com/articles/openai-astra-trademark-lawsuit-tradesun). For a startup selling to banks, being mistaken for a wrapper on someone else's model is a business problem before it is a legal one.

## What does a federal trademark registration actually do in a fight like this?

| **It does three things a common-law claim can't do as easily.** It gives you nationwide priority from your filing date [under 15 U.S.C. § 1057(c)](https://www.law.cornell.edu/uscode/text/15/1057). It is presumed valid in court [under § 1115(a)](https://www.law.cornell.edu/uscode/text/15/1115). And it sits in a public database that a bigger company's lawyers can search before they pick a name, which matters when a court later asks what they knew. |
| --- |

The ASTRA registration has already been doing work. The USPTO record shows other companies filing ASTRA for software, and several of those applications are sitting in suspension, including one from BizUpUSA Holdings. I haven't read those suspension letters, so I won't tell you why each one stalled. I can tell you BizUpUSA petitioned to cancel TradeSun's registration in April 2026, and that proceeding ended on July 13 with the registration still standing, [per the same USPTO record](https://tsdr.uspto.gov/statusview/sn90742200).

One more detail from the paperwork. As of October 9, I found no ASTRA application in OpenAI's name in the USPTO's trademark search system. That doesn't decide anything. Rights in the United States come from use, and a company can launch before it files. But it's a reminder that the small company here is the one with the federal registration.

| The registration doesn't win the case. It decides whether you get to have one. |
| --- |

## What does the ASTRA registration not own?

It owns ASTRA for the services listed: AI document classification, extraction and processing. It does not own the word ASTRA across technology, and that matters. The USPTO search shows a crowded field: ASTRA ULTRA, ASTRA COREX, AHEAD ASTRA, and a new ASTRA application from Topaz Labs filed in September, among others. Expect OpenAI to argue the name is common and the customers are different. A registration is protection for a lane, and the width of your lane is set by the words in your goods description.

## Here's what I'd check if a bigger company launched your product name

If I were your trademark attorney and you called me the week a giant launched under your name, this is the order I'd work in. It is also the order I'd want you to have handled before that call.

| 1 | Your goods description against what you sell today. TradeSun's registration says document classification and data extraction. Its platform now pitches agentic AI for global commerce. If your product grew past your registration, the gap is where the other side will push. |
| --- | --- |
| 2 | Your maintenance deadline. A registration needs a declaration of continued use between the fifth and sixth year, [under 15 U.S.C. § 1058](https://www.law.cornell.edu/uscode/text/15/1058), or it gets cancelled. For a May 2022 registration, that window opens in May 2027. Don't let a calendar miss hand a giant an easy win. |
| 3 | Evidence of confusion, starting now. Save every misdirected email, sales call and support ticket where a customer asks if you're connected to the bigger brand. Reverse confusion cases are built on these moments, and nobody remembers them six months later. |
| 4 | Your next product names. If you're launching modules, an AI agent or a new tier, file for those names before the giant's marketing makes your next move look like the derivative one. |
| 5 | Who else is in your lane. Run a fresh search. A crowded field cuts against you on strength, and you want to know that before you decide how hard to push. |
| 6 | What you actually want. An injunction, a payment, a coexistence agreement, or money to rebrand on your terms. Each one leads to a different first letter. |

## Is a trademark for an AI startup worth filing before you raise?

| **Yes, if the name is already in front of customers or investors, because the filing date is the asset.** A trademark for a SaaS company or AI startup covers the product name for the listed software or services from the day you file, subject to anyone who used or filed first. Waiting until after the round means a bigger player can launch, or file, in between. |
| --- |

This is where I'd push back on a common founder instinct. Teams treat the trademark as paperwork for later, then spend six figures on brand, domains and a launch. If you want to protect a startup brand name, the filing is the smallest line item in the stack and the one you can't buy back once someone else's date comes first. A trademark monitoring service is the second piece: it won't stop a giant from launching, but it tells you the day a conflicting application shows up.

## The honest complication

Reverse confusion cases are hard. Courts weigh how strong the name is, how close the products are, who buys them and how carefully, and a crowded field like ASTRA's makes that analysis harder for the smaller company. They're also expensive, and a small company litigating against one of the best-funded companies on earth carries real risk even with good facts. Many of these disputes end in settlements that look a lot like a negotiated rebrand.

That's not a reason to skip the registration. It's the reason to have it. A federal trademark registration is leverage, not a guaranteed win. Law Commentary notes that a separate dispute over OpenAI's io name led to an injunction before the parties settled in July. Whether any of that happens here is up to the court and the parties, and I'm not predicting an outcome. What I'll say is that leverage in a negotiation like this is built years before the negotiation starts.

| They have the budget. You have the filing date. |
| --- |

So picture the morning a customer forwards you a launch announcement with your product's name on it, from a company your whole industry watches. You can either start explaining that you were here first, or you can open a drawer and pull out a federal registration that says so. Build so that you stay in control.

## Frequently Asked Questions

### Can a small company sue a big company for using its trademark?

Yes. Size doesn't decide trademark rights; priority and likelihood of confusion do. When a bigger, later company's use makes customers think the smaller company is the copycat, courts in many circuits recognize a reverse confusion claim.

### Does a federal trademark registration cover my whole company?

No. It covers the mark for the goods or services listed in the registration. If your software now does more than the description says, consider new applications for the expanded products so your protection matches your business.

### What should I do if a bigger company launches my product name?

Preserve evidence of customer confusion, confirm what your registration covers and when maintenance is due, and talk to a trademark attorney before sending anything. Your first letter should match the outcome you actually want.
